Mumbai, Oct 10: Company management cannot itself be a judge in the complaint of sexual harassment, Bombay High Court has held in a recent judgement. The company, in such a case, must appoint a complaints committee -- headed by a woman and having a representative of an NGO -- as contemplated by the Supreme Court in the famous 'Vishakha' case, High Court held. In the present case, Usha Ispat, the company, had appointed an advocate to inquire into allegations of harassment by one of the female employees at its Satarada plant in Sindhudurga district. But division bench of Justices Ranjana Desai and Dhananjay Chandrachud, in the judgement this week, held that such internal inquiry was not enough.
