Ferguson drunken-driving pretrial hearing adjourned until August

BY GINA DAMRON • FREE PRESS STAFF WRITER • July 25, 2008 The pretrial hearing in Southfield’s 46th District Court for Bobby Ferguson, a Detroit contractor charged with drunken driving, was adjourned today until Aug. 26. His attorney Brian Stacey plans to file a motion to suppress the tests administered by the Southfield Police Department to Ferguson to check his blood alcohol levels after he was arrested. Assistant City Attorney Bonnie Fitch said the first test came back invalid and a second test was administered two or three minutes later. Stacey said officers should have waited at least 15 minutes before administering the second test. Fitch said that it’s suggested, but not mandatory, that officers wait 15 minutes after an invalid test before administering another. She said it’s unlikely that the results will get thrown...
