SAN FRANCISCO (KGO) -- Same sex couples are taking their fight to overturn Proposition 8 to federal court for the very first time. They claim the ban on gay marriage passed by California voters violates the U.S. Constitution. This latest legal challenge basically argues discrimination; claiming that the state ban on same-sex marriage violates the constitution's guarantee of equality. Groups on both sides of the issue rallied in San Francisco in May after the state supreme court upheld the 2008 voter-approved ban on same-sex marriage.
