Court reinstates $300M lawsuit against Pepsi

NEW YORK (AP) - A Peruvian bottler's lawsuit seeking more than $300 million from PepsiCo Inc. was reinstated by the U.S. Court of Appeals for the Second Circuit, which overturned a dismissal of the case by a judge in the U.S. District Court for the Southern District of New York. Peruvian bottler Compania Embotelladora del Pacifico SA alleges PepsiCo breached a long-standing contract with the bottler, which had provided exclusive rights to bottle soft drinks in various areas of Peru. According to a statement from attorney Robert Y. Lewis, of Freeman Lewis LLP, Compania Embotelladora claims PepsiCo encouraged the bottler's rivals to sell soft drinks at lower prices than Compania Embotelladora in the exclusive territory, violating the contract.
